1. Acceptance of Terms

By accessing or using Pressrun (“the Service”), operated by Pressrun (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age to create an account or use the interactive features of Pressrun. By creating an account, you represent that you are at least 13 years old. If we learn that an account has been created by someone under 13, we will terminate the account and delete associated personal information.

3. Account Registration

To access certain features you must create an account. You agree to:

  • Provide accurate and complete registration information.
  • Maintain the security of your password and account.
  • Notify us immediately of any unauthorized use of your account.
  • Accept responsibility for all activity under your account.

4. User Conduct

You agree not to:

  • Post content that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Harass, bully, or intimidate other users.
  • Use the Service to distribute spam, unsolicited messages, or malware.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated means (bots, scrapers) to access the Service without our written consent.

5. User-Generated Content

You retain ownership of content you submit (such as comments). By posting content to the Service, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, display, and distribute that content in connection with operating and improving the Service.

We reserve the right to remove, edit, or hide any user-generated content at our sole discretion, for any reason, without notice. This includes but is not limited to content that violates these Terms, is reported by other users, or that we determine to be harmful to the Service or its community.

We have no obligation to monitor, screen, or review user-generated content prior to or after posting. Our decision to remove content in some instances does not create a duty to remove content in all instances.

You are solely responsible for the content you post. We do not endorse, verify, or assume liability for any user-generated content.

6. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by Pressrun and are protected by copyright, trademark, and other intellectual property laws.

News articles, headlines, and media linked through the Service are the property of their respective publishers. Pressrun curates and links to third-party content but does not claim ownership of it. Pressrun does not control, endorse, or assume responsibility for the accuracy, legality, or content of any third-party materials linked through the Service. Access to third-party content is at your own risk and subject to the terms of the respective publishers.

7. Copyright Infringement (DMCA)

We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright, please submit a notice pursuant to the Digital Millennium Copyright Act (17 U.S.C. §512) to [email protected]. We will respond to valid notices and may remove infringing content and terminate the accounts of repeat infringers.

8. Account Termination

We may suspend or terminate your account at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to:

  • Violation of these Terms of Service.
  • Conduct harmful to other users, third parties, or the Service.
  • Prolonged inactivity.
  • Requests by law enforcement or government agencies.

You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We may retain certain data as described in our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Pressrun and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant the accuracy, completeness, or reliability of any third-party content accessible through the Service, including news articles, headlines, and linked media. You acknowledge that any reliance on such content is at your sole risk. We are not liable for any loss or damage arising from your reliance on third-party content accessed through the Service.

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is less.

10. Indemnification

You agree to indemnify, defend, and hold harmless Pressrun and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) any content you submit, post, or transmit through the Service, including but not limited to claims of defamation, copyright infringement, trademark infringement, or violation of any third party’s right of publicity or privacy; (c) your violation of these Terms; or (d) your violation of any applicable law or any rights of a third party.

11. Dispute Resolution

These Terms shall be governed by the laws of the State of Montana, without regard to conflict of law principles.

Any dispute arising under these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in the State of Montana. You and Pressrun each waive the right to a jury trial and the right to participate in a class action, collective action, or representative proceeding.

If arbitration is found unenforceable, disputes shall be resolved in the state or federal courts located in Montana, and you consent to personal jurisdiction therein.

Any claim must be brought within one (1) year after the cause of action accrues, or it is permanently barred.

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemics, labor disputes, government action, internet disruption, or infrastructure failure.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the “Last updated” date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

14. Severability; Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Pressrun regarding your use of the Service.
